Why arbitration
The parties to many commercial contracts choose arbitration so that a disagreement is settled through a procedure they agreed on in advance. Our work starts at the arbitration clause itself: how it is drafted, and what follows from it for jurisdiction and procedure.

Can we arbitrate without a clause in the contract?
The parties can agree to arbitrate after a dispute has arisen. A clause in the contract makes the route clearer, but its absence does not prevent an agreement to arbitrate.
